Most of us, being United States citizens, would like to believe that everyone in this country is living in conditions of utmost freedom and equality. Racism, in itself, is a belief that a person holds; it forces another being to be placed at a lower status within one's mind and in the society as a whole. Keeping Blacks and other minorities at a lower level was the principal state of mind for many of the whites during the early part of the twentieth century. This kind of mentality exists in our society till this day among certain groups of people. The cold and harsh manner with which the Blacks were treated takes us all the way back to slavery. Back in those days the majority of this country's population accepted it. The oppressed African Americans eventually began to become more organized and started to fight for the civil rights they deserved as citizens of the United States. Despite the attempts of the Civil Rights Movement, much damage was already done; unfortunately many minds were already tarnished with negative images of what the Black person was and could ever be. In spite of the fact that many Black people were working towards moving up and making a life for themselves, racism continuously kept them from advancing in the society.


The high hopes were soon brought back down, as the Blacks were welcomed to the cities by the overwhelming mentality of the masters looking down on their slaves. They encountered landlord after landlord turning them away because of their unwillingness to rent to Blacks and other newly migrated minorities. It was this constant refusal to integrate housing that eventually caused the creation of minority driven neighborhoods. Since the majority of the whites turned their backs on Blacks and the other minorities, African Americans were forced into forming the types of communities that contained people of their race and poor financial state. Many of them came looking to move ahead in their new lives that they were recently granted by the constitution; but they were only pushed to join the fairly new neighborhoods, which were slums compared to those inhabited by the dominating white residences. The reason for this type of segregation could be explained as another tool of racism for the white man's advantage. The effects of these neighborhoods were more damaging then the simple prevention of Blacks and other minorities from integrating with the whites. By zoning the individual into compartments determined by color, it excluded the opportunity for a fusion of interests. By confining children to separate neighborhood schools and playgrounds, it sharpened the lines of distinction and developed illusions of superiority. It was in housing that segregation received its greatest impetus and momentum.


In my opinion this is definitely a violation of certain civil rights. Police are taking action before they have proper cause to do so. Although I do agree that much of the riot activity is becoming quite out of control, I feel that it is necessary to have a crime committed before going ahead and labeling these teens just based on their appearances. It may appear to be easy for an outsider to suggest that these people should simply find their way out of these hopeless neighborhoods and cities and start new lives. Once again, as it was already proven in the past, this is not as easy as it may seem. The lives that these people are living are not ones that they were forced to accept and live with. The issue of civil rights and equality, which were the major factors, involved with Black people in the sixties. It is important to see that because the discriminations Black people had to deal with in the early part of the 0th century had a very significant effect on the lives of the future generations. Forced to live in designated neighborhoods, Blacks were never able to break the cycle of poverty that they lived in and continued to raise families in the same type of environment. Although Black are a big issue in the ghetto type cities, it is important to understand and to realize that Black community are a part of our socities.

Medieval times was a very dangerous time period. The medieval period lasted from about 400AD to about 1500 AD. This time was very different than from the way life is now. Medieval Europe was a very dangerous time period. Government, the public, and the warfare were all different. In feudalism, no one actually owned land. The king owned the land as a "trust from God," and then gave it away to others. The first people the king would pass land to were the nobles, and from them it was passed to the lower ranks of the people. The people who held these lands had to pay fees or rents, called fiefs. In the feudalist system, vassals were below the lords. When a vassal met a lord, they had to give the lord their sword and then say a prayer to the lord. The lord would then kiss the vassal and return the sword to him. Occasionally, if the lord liked the vassal, he would give him a plot of land, called a seizin. In order to pay for this land, the vassal had to offer military service. He had to appear in the battlefield, fully armed, and have a few men to fight with him. He generally had to serve for 40 days in war, or as a guard in the lords castle. Also, he had to appear in the lord's court, and give advice or act as a juror. At the bottom of the feudal pyramid was the peasant farmer. Some were slaves, bound to land and considered property, like cows or sheep, and some were free, and they held land like everyone else except they paid their service by doing work on the land. They divided this work between their own fields and the lords fields. Peasants in good shape would hire laborers to do the work in the lord's fields. For the fief, the land was inherited by the eldest son. It was held in exchange for money, labor, or farm produce. War in medieval times was very different from war nowadays. War revolved around castles. Enemy castles were major military and political objectives. Mark Twains Adventures Of Huckleberry Finn is an adventurous story of a young boy (Huck) who orphans himself from the average young mans life. This young man slips from the clutches of his drunken father and sets out for adventures of his own. In doing so, he meets with a fugitive slave named Jim. When he befriends a runaway slave named Jim, social issues are brought up and Huck is forced to follow what his heart says, instead of what society says is morally acceptable. I enjoyed how Twain portrayed Huck and Jims journey down the river and the adventures they shared. It was a symbol of their need for freedom. By sharing the same goals, Huck and Jim become true friends. They are beyond the color barrier and realize that a person is a person, regardless of what they look like or who they are. I think much of todays society could benefit from reading this book. It helps you put things in perspective and think about what is really important in life; what others think versus how you feel. Monetary policy is the manipulation of interest rates to influence economic activity, whilst fiscal policy is the use of the government budget (variations in the level and composition of taxation and spending) to influence the economy. Monetary policy remains the most important economic management tool, and since the early 10s has played the central role in the management of economic growth and inflation in Australia. For the past decade the RBA has conducted monetary policy with the main aim of achieving its 'inflation target' of - per cent over the course of the economic cycle. Whilst low inflation is not an end in itself, the RBA believes that keeping price growth within the target range is the key to achieving the goals of sustainable economic growth and low unemployment. Under the Howard government however, fiscal policy has taken on a less active economic role. Fiscal policy is no longer actively used to influence the level of economic growth nor to achieve external balance. In fact, the objective of external balance is no longer directly pursued by the current government. Instead, fiscal policy is a supplementary demand management tool, with the main aim being to achieve budget balance over the course of the economic cycle. This goal of fiscal balance ensures that the government does not draw from the savings pool and 'crowd out' the private sector (thereby indirectly assisting external stability), as well as having other political advantages.


The RBA needs to take many factors into account when conducting monetary policy. Theoretically, interest rates are raised to exert contractionary pressure on an overheated economy, and lowered to promote growth when economic activity is stagnant. Whilst MP is relatively quick to implement (the RBA Board convenes every month), changes to interest rates often take 1 18 months to have an impact on the economy. This time lag needs to be taken into account when conducting MP, and the RBA often needs to act preemptively and forecast where the economy will be positioned in the business cycle when the impact of MP changes are seen. At present the RBA has kept interest rates steady at 4.75 per cent for more than a year, yet many economists are forecasting that rates will fall in the second half of 00. According to the RBA formula, when inflation is within the target band, then an interest rate level below 5.5% is considered expansionary. Therefore, the current interest rate should be having a mildly stimulatory effect on economic activity, supporting the fact that Australia's current growth rate (.% in March 0) is below the long term sustainable rate of .5 to 4 per cent. The RBA also did not react to the fact that for a brief period in early 00 inflation rose outside of its target band to .4 per cent in March. This reflects the fact that the inflation target is not an 'electric fence', but rather a goal to be achieved as an average over the course of the business cycle. This frees up monetary policy to be used for demand management in the short term.


There is increasing pressure on the RBA to ease monetary policy through an interest rate cut due to the less than promising outlook for the world economy. In addition, the domestic growth rate is well below its sustainable average, still suffering from the effects of the drought. Also, by reducing the interest rate differential between ourselves and the rest of the world (current interest rates are only 1% in the US and 0% in Japan), this would reduce upward pressure on the Australian dollar and lessen the negative impact of the weak global economy on our export markets. However, the RBA has also expressed its concern about the continuing boom in home building and property prices, being fuelled by a growth in credit. This reflects the fact that monetary policy is a relatively blunt economic instrument. A change in interest rate has an effect on every aspect of the economy, making it difficult for the RBA to move rates in either direction. Ideally, monetary policy should be used hand-in-hand with fiscal policy to achieve economic objectives, as FP can be more highly targeted to specific areas in the economy. For example, expansionary fiscal policy could be used to address the current situation of slow economic growth, whilst leaving interest rates steady as not to over-stimulate the property market. However, the fact that the government no longer uses fiscal policy as a serious macro-economic instrument means that this would be difficult to achieve. In reality, the Budget is now used mostly as a political instrument due to the public misconception that balanced budgets are a reflection of sound economic management. Balanced budgets also prevent the political opposition from being able to use any surplus funds should they come to power. It seems that the Government's political agenda has rendered fiscal policy close to impotent in terms of its macroeconomic impact in the economy.

There is a process in which to remedy discrimination against an employee. I will discuss the practices that need to be followed in order to file a formal complaint with the EEOC. I will also talk about the civil litigation process from the state level through the Supreme Court. I researched these topics at length on the Internet, and have found that there are many different steps that need to be taken in order to come to resolution of a complaint.

I researched this topic in a variety of different ways. I read the textbook assigned to this class as well as searching the Internet for any relevant information.


A person who feels that they have been discriminated against must first contact an EEO counselor. This must be done within 45 days of the incident and prior to filing a formal complaint. This "notice" advises them that they have 15 days to file a complaint. Once a formal complaint is filed, the agency has 180 days to investigate the complaint. The agency will then provide the complainant with a copy of their investigative file. The complainant then has 0 days to request a hearing and a decision from an EEOC AJ. Once a request for a hearing has been received and the complaint file has arrived, the AJ must conduct the hearing within 180 days. Once a decision has been made, the AJ must issue a final order within 40 days. Each complainant has the right to appeal the final order. When filing an appeal, "The EEOCs decision will be based on a preponderance of the evidence. The decision will also inform the complainant of his or her right to file a civil action." If this is not done within the time period allotted, the plaintiff has the right to apply to the court for a default judgement. If the defense needs more time to prepare the action, the plaintiff's lawyer can grant a reasonable extension. This is a common practice as 10 days is not enough time to advise a client, and prepare a proper defense. Once the defense has been received both sides start the information gathering process. They will review documents, and interview people and prepare a "book of documents". This book has to be served upon the defendant's lawyer, and a list of the documents must be filed with the court. Once the defendant's lawyer receives this book, he has 10 days in which to produce the "defendants book of documents". As with the defense, the plaintiff's lawyer may grant an extension. Once the document disclosure has been accomplished, the discovery phase takes place. This is where both sides "discover" each other's witnesses. They interview some or all of the witnesses under oath, and this interview is recorded, and may be used in court later. The interview has to take place when both lawyers can be present, and the witness has the amount of time available that the lawyer needs. Once all the documents have been exchanged, and the discoveries are completed, both sides need to submit to the court a "Certificate of Readiness for Trial". This tells the court


whether or not both sides feel that it would be beneficial to have a settlement conference before the judge. If they feel that it would be beneficial, a date is set and both lawyers must be available for that whole day. Each lawyer has to prepare a "Settlement Conference Brief", and this has to be submitted to the court before the conference date. Each side will present the case that they must meet. This is done informally, and no witnesses are called. The clients may or may not be present. At the settlement conference, the judge will attempt to facilitate between the two parties. If no resolution can be reached, the judge will make a non-binding judgement. The parties can choose to accept it or continue to trial. A different judge who has no knowledge of the outcome of the settlement conference will hear the trial. Once it has been determined that a case must go to trial, a pre-trial conference date is set. On that date both lawyers meet briefly with another judge so that the judge can determine that both parties agree upon the issues for trial, all preliminary matters have been dealt with, and that both parties are ready to proceed to trial. At this time a trial date is set, and the lawyers work to prepare all witnesses for trial and gather all other documentation needed. At the end of the trial, the judge reserves the right to go back over all the evidence presented, and will not necessarily make a judgement immediately.


The civil litigation road is a long one. Although the process is very orderly, and the steps are logical, they are all very time consuming. To resolve a civil litigation case successfully, you must have a good understanding of the process, and be able to use it effectively.
